Acceptance of Terms

By accessing or using dplooy's drag-and-drop web hosting platform (“the Service“), including our instant website deployment, multi file hosting, and custom subdomain hosting features, you agree to be bound by these Terms of Service (“Terms“). If you disagree with any part of these terms, you do not have permission to access the Service.

Eligibility

• •You must be at least 13 years old (16 in the EU) to use the Service
• •You must provide accurate and complete registration information
• •You are responsible for maintaining the security of your account
• •You must notify us immediately of any unauthorized access

dplooy as a Hosting Platform

dplooy operates as a neutral hosting platform that provides tools for users to upload, host, and share content. dplooy is not the author, publisher, or creator of any user-uploaded content. All content hosted on the platform is created and uploaded solely by users, and the views, opinions, and materials expressed or shared through user-hosted websites and files do not represent the views of dplooy.

dplooy acts solely as an intermediary and passive conduit for user content. We provide the hosting infrastructure and tools; users are entirely responsible for what they upload and publish.

No Obligation to Monitor

dplooy has no obligation to pre-screen, monitor, review, moderate, or inspect any content uploaded by users. We do not and cannot review all content hosted on the platform. The absence of monitoring does not imply approval or endorsement of any content.

However, we reserve the right (but not the obligation) to review, screen, or remove any content at our sole discretion, at any time, without prior notice, and without liability to you, for any reason or no reason, including but not limited to content that we believe violates these Terms or applicable law.

User Bears Entire Risk

You acknowledge and agree that:

• •You are solely and entirely responsible for all content you upload, host, publish, or share through the Service
• •You assume all risks associated with hosting content publicly on the internet, including any legal, reputational, or financial consequences
• •dplooy is not responsible or liable for any damages, claims, losses, or disputes arising from your content or your use of the Service
• •Your content must comply with all applicable laws and regulations in every jurisdiction where it is accessible
• •dplooy is not a backup service; you are responsible for maintaining your own copies of all content

No Endorsement of User Content

The availability of any content on dplooy does not constitute an endorsement, recommendation, or approval by dplooy of such content. We do not verify the accuracy, completeness, legality, or quality of any user content. Any reliance on user-hosted content is at your own risk.

Account Creation

When you create an account with us, you must:

• • Provide accurate, current, and complete information
• • Maintain and promptly update your account information
• • Choose a strong password and keep it confidential
• • Accept all risks of unauthorized access to your account

Account Security

You are responsible for:

• • All activities that occur under your account
• • Maintaining the confidentiality of your login credentials
• • Notifying us immediately of any security breach
• • Ensuring no one else uses your account

Your Content

• ✓You grant us a license to host and serve your content

• ✓The license ends when you delete your content

Your Responsibilities

dplooy‘s Intellectual Property

The Service, including its original content, features, and functionality, is owned by dplooy and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Reporting Copyright Infringement

To report copyright infringement, send a DMCA notice to dplooyinc@gmail.com with:

• • URL of the infringing content on dplooy
• • Your contact information
• • A statement of good faith belief
• • A statement of accuracy under penalty of perjury
• • Your physical or electronic signature

Free Tier

• • Limited to 3 active projects
• • 5MB maximum file size
• • 50MB total storage
• • Files automatically expire after 3 days
• • Subject to change with 30 days notice

Paid Plans

Billing Terms

• • Subscriptions renew automatically
• • Cancel anytime, effective at end of billing period
• • No refunds for partial months
• • Prices may change with 30 days notice
• • All payments processed securely by Stripe

Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. The Service may be unavailable due to:

• • Scheduled maintenance (with notice when possible)
• • Emergency maintenance or security updates
• • Events beyond our reasonable control
• • Third-party service outages

Support

Data Backup

You are responsible for maintaining your own backups. We are not liable for any loss of data.

Service Provided “As Is”

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. DPLOOY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT HOSTED ON THE PLATFORM IS ACCURATE, RELIABLE, COMPLETE, OR LAWFUL.

No Liability for User Content

DPLOOY IS NOT LIABLE FOR ANY CONTENT UPLOADED, HOSTED, PUBLISHED, OR SHARED BY USERS OF THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO ANY ERRORS, OMISSIONS, DEFAMATION, INTELLECTUAL PROPERTY INFRINGEMENT, ILLEGAL CONTENT, OR ANY OTHER HARM ARISING FROM USER CONTENT. YOU ACKNOWLEDGE THAT DPLOOY HAS NO OBLIGATION TO REVIEW USER CONTENT AND DOES NOT ENDORSE ANY USER CONTENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DPLOOY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, REGARDLESS OF WHETHER DPLOOY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).

Specific Exclusions

Without limiting the above, dplooy shall not be liable for damages arising from:

• • Any content uploaded by users, including illegal, harmful, or infringing content
• • Unauthorized access to or alteration of your data or transmissions
• • Loss of data or content due to service interruption, account termination, or system failures
• • Actions taken by dplooy in good faith to enforce these Terms, including content removal or account suspension
• • Third-party websites, services, or content accessed through user-hosted sites
• • The conduct of any third party using the Service
• • Any failure to maintain the confidentiality of your account credentials

Maximum Liability

IN NO EVENT SHALL DPLOOY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.

Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. YOU ASSUME FULL RESPONSIBILITY FOR ALL RISKS ASSOCIATED WITH HOSTING CONTENT ON THE INTERNET, INCLUDING BUT NOT LIMITED TO RISKS OF DATA LOSS, UNAUTHORIZED ACCESS, CONTENT THEFT, LEGAL LIABILITY FROM YOUR CONTENT, AND REPUTATIONAL HARM.

By You

You may terminate your account at any time through your account settings. Upon termination:

• • All your data will be deleted immediately
• • No refunds will be provided for unused time
• • You remain liable for any charges incurred

By Us

We may terminate or suspend your account immediately, without prior notice, if:

• • You breach these Terms
• • You engage in fraudulent or illegal activities
• • You haven‘t accessed your account for 12 months
• • Required by law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

1. Good faith negotiations between the parties
2. If negotiations fail, binding arbitration under the rules of the American Arbitration Association
3. Arbitration shall be conducted in Delaware

Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court. Additionally, nothing in these Terms prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

Entire Agreement

These Terms constitute the entire agreement between you and dplooy regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Electronic Communications Consent

By creating an account and using the Service, you consent to receive electronic communications from dplooy, including service-related emails (account verification, password resets, security alerts, file expiration notices, billing confirmations), and updates about material changes to our Terms or policies. These service-related communications are not marketing and cannot be opted out of while maintaining an active account. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Survivability

The following sections shall survive the expiration or termination of these Terms and your account:
